You know, child models in skimpy outfits can count as child pornography in the US. Contrary to popular myth it's not purely a matter of whether the genitals and nipples are visible. If the poses are seductive and the crotch and chest are barely covered then that site is skating on thin ice. There are court precedents ruling that in addition to butts and genitals the whole crotch and upper thighs area is part of the forbidden zone.
I've heard of a few cases like what you're saying, but that would be ruled unconstitutional if the lawyers were good and the judges and jury actually knew what they were talking about (as the usually don't, because their moral convictions usually stand in the way of their decisions) actually argued. I think what matters more is if they're wearing clothes or not. For example, a girl lying on her stomach without a bra is worse than a girl wearing a bra that's really skimpy. No matter what, though, not a single member of 12chan has been prosecuted for non-cp they actually got from that site, recently, anyway. And earlier this year, they were investigated by the feds and found to be legal, they just had to tighten their ban on cp.
